Dismissals, warnings and workplace disputes

Dismissal and unfair-dismissal protection

A particular focus is advice and representation in connection with ordinary and extraordinary dismissals. Employees are assisted in reviewing a dismissal, bringing unfair-dismissal proceedings and negotiating an agreed termination of employment. Continued employment, severance, garden leave and other termination terms may all be relevant. In Germany, an unfair-dismissal claim generally has to be filed within three weeks after receipt of the dismissal. Employers are also advised on preparing and implementing dismissals and represented in related negotiations and litigation.

Warnings and workplace disputes

A formal warning can significantly affect the future course of an employment relationship and may prepare the ground for a later conduct-related dismissal. The law office reviews warnings and advises on whether and how unjustified allegations should be challenged. Advice also covers conflicts during ongoing employment, including allegations of misconduct, disputes about duties and responsibilities and situations in which termination is becoming likely.

Termination and settlement agreements

An agreed termination is not only about a possible severance payment. Garden leave, remaining holiday, post-contractual obligations and potential social-security consequences can be equally important. The law office reviews and negotiates termination and settlement agreements and assists in developing an appropriate negotiation strategy.

Employment and managing-director contracts

The law office also advises on drafting and reviewing employment agreements and managing-director service agreements, as well as disputes concerning their performance and termination.
