The German Residential and Care Contracts Act (WBVG) imposes specific requirements on agreements combining accommodation with care or support services. For care providers, both the contract and the information supplied before signature are therefore important.
Transparent services and charges
Residents should be able to understand which services are provided and how the total charge is composed. Care fees, accommodation, meals, investment costs and any additional services should be presented clearly and separately.
Pre-contractual information
The information required before contract conclusion is intended to enable prospective residents to assess the offer. It should therefore correspond with the later contract. Deviations and subsequent changes need to be handled transparently.
Additional services and special arrangements
Additional services should be clearly described and separately agreed. Provisions on termination, house rules and changes in care needs must also comply with the statutory framework.
Regular review of documents
Care providers benefit from reviewing contracts, annexes and pre-contractual information as one coherent set. This helps avoid conflicting versions, outdated fee information and incorrect cross-references, while also simplifying day-to-day administration.
